Terms and conditions of sale

These terms govern the sale of accompanied sports outings offered by Rémi Conte — Atrypical (“the provider”) to any individual booking through this site (“the customer”).

Placing a booking means accepting these terms in full, in the version in force on the day of the order.

The provider offers to share its own training sessions — road cycling, running, open-water swimming, swimrun and triathlon — in Nice and along the French Riviera. These are not lessons, a teaching camp, or supervision within the meaning of article L. 212-1 of the French Sports Code: the customer joins a practice, they are not directed in it.

The duration, maximum group size and price of each format are shown on the relevant outing page. The meeting point, route and exact time are sent to the customer at least 48 hours before the start.

The accompanying athlete may change the route for reasons of safety, weather or group condition, without this giving rise to any compensation.

The customer books by selecting a published time slot or proposing a date, then completing the booking form.

At that stage the request is not yet binding: it becomes a contract once the provider has accepted it and the deposit has been collected. The customer then receives a confirmation email summarising the outing, the date and the amount.

The provider may decline a request, in particular where the stated ability level does not match the outing or the slot is full. Any deposit already paid is then refunded in full.

Prices are shown in euros, all taxes included, at the 20% VAT rate.

The price includes taking part in the session alongside the athlete and [specify: route reconnaissance, refreshments, equipment loan...]. It includes no teaching, coaching or training-follow-up service.

It does not include travel to the meeting point, the participant's own equipment, their licence or personal insurance, or catering, unless stated otherwise on the outing page.

Group outing prices are per person; the supplement per additional participant is shown on each format.

A deposit of 30% of the total price is payable on booking, by card, through the payment provider Stripe.

The balance is due no later than 48 hours before the start. It is paid online, via the link sent by email or from the customer area. No payment is taken at the meeting point.

The provider never has access to the customer's card details: they are handled directly by Stripe.

Failure to pay the balance within the stated period entitles the provider to cancel the outing and retain the deposit.

Cancellations must be sent in writing to contact@rivieraendurance.com. The following scale applies from the date of receipt:

More than 14 days before the outing: the deposit is refunded in full.

Between 14 and 7 days before the outing: 50% of the deposit is retained.

Less than 7 days before the outing, or failure to appear: the full deposit is retained and the balance is not due.

Refunds are made to the original payment method within 14 days.

Safety takes precedence over running the outing. The provider may cancel or cut short an outing in dangerous conditions — storms, wind, swell, water temperature, heat, road surface — or if the athlete is unavailable.

The decision is communicated to the customer at least 3 hours before the meeting time.

The customer is then offered, at their choice, a new date agreed together or a full refund of all sums paid. No other compensation is due.

An outing cut short after the start for safety reasons remains payable in full.

Under article L. 221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure services supplied on a specific date or for a specific period.

The customer acknowledges being informed of this before confirming their booking. Only the cancellation scale in article 6 applies.

The customer declares that they are in good physical condition, medically fit to take part in the activity booked, and autonomous in that practice. Autonomy is a condition of booking: the provider offers no instruction and no supervision.

The provider may require, before the start, a medical certificate of no contraindication issued within the last 12 months or a signed self-declaration.

The customer undertakes to inform the accompanying athlete, before the start, of any health condition, treatment or injury that could affect their participation or the safety of the group.

Minimum age: 18. Minors are not admitted, as participant autonomy is a condition of booking.

Participants take part under their sole responsibility. They remain in control of their own pace, route and decisions, and are free to stop at any time. Safety information given by the accompanying athlete does not constitute supervision and transfers no liability.

On the bike: the French Highway Code applies in full; wearing a hard-shell helmet is a contractual requirement, including for adults; the bicycle must be in good working order, brakes and tyres included.

In open-water swimming and swimrun: a swim buoy is mandatory; a wetsuit may be required depending on water temperature; municipal orders and authorised swimming zones are observed at all times.

The provider may refuse the start of, or end, the participation of any person whose behaviour, equipment or condition endangers their own safety or that of other participants, without refund.

As each person takes part under their own responsibility, every customer must hold personal accident cover and personal liability insurance. A federation licence (FFTri, FFC, FFA) is strongly recommended.

The provider accepts no liability for theft, loss or damage to participants' personal equipment.

Photographs and video may be taken during outings. Publishing them for promotional purposes requires the participant's prior written consent, collected separately from the booking.

That consent can be withdrawn at any time by writing to contact@rivieraendurance.com, without having to give a reason.

The processing of customer data is described in the privacy policy, which forms an integral part of these terms.

Complaints should be sent to contact@rivieraendurance.com. The provider undertakes to reply within 30 days and to seek an amicable solution.

These terms are governed by French law. Failing an amicable settlement, disputes fall under the courts having jurisdiction under ordinary law.
